Terms of Service

In short

I am Ali Jabbary, a sole proprietor based in Canada offering 1-on-1 online tutoring and small custom technical projects. These terms cover how booking, payment, refunds, rescheduling, recordings, intellectual property, and liability work. By using the site or booking a session, you agree to them.

1. Who I am

Ali Jabbary Tutoring is a sole proprietorship operated personally by Ali Jabbary (M.Sc., P.Eng.) in Canada. There is no separate incorporated entity; all tutoring is delivered by me. Contact: [email protected].

2. Acceptance of terms

By creating an account, booking a session, or otherwise using alijabbary.com, you agree to these terms and to the Privacy Policy. If you do not agree, please do not use the service.

These terms apply to everyone who uses the site: students, parents booking on behalf of a minor, and visitors browsing without an account.

3. What I offer

  • 1-on-1 live online tutoring in Python, AI/ML, Data Science, Engineering, Math, Excel, and adjacent technical subjects (full list on the /tutoring page).
  • A free 30-minute introductory session for new students.
  • Paid single sessions, multi-session packs, and monthly plans (current rates on /pricing).
  • Optional add-ons such as session recording, written summary, and between-session Q&A.
  • Custom small technical projects (Python automation, data analysis dashboards, ML notebooks, Excel/VBA, AI workflow integration) scoped through the project request form.

4. Educational scope and academic integrity

Tutoring is educational support. It is not a guarantee of any specific grade, exam result, admission, certification, or job outcome. Results depend on the time you put in, your starting level, and circumstances I do not control.

I help students learn, debug, and prepare. I do not write, submit, or sit for assignments, exams, take-home tests, or interviews on a student's behalf, and I will not help with work that violates a school, employer, or licensing body's academic-integrity rules. During a session I will explain concepts, work through similar examples, review your draft solutions, and point out mistakes — the work you submit must remain your own.

If a request crosses that line, I will decline and offer a different way to help.

5. Accounts

  • Provide accurate name, email, and time-zone information when you sign up.
  • Keep your password and any OAuth-linked accounts secure. You are responsible for activity on your account.
  • One account per person. Do not share credentials.
  • Tell me immediately if you suspect unauthorized access.

6. Age and parental consent

Tutoring is intended for adult learners. If the student is under 18, a parent or legal guardian must be the one who creates the account, books the sessions, and accepts these terms on the student's behalf. I do not knowingly contract with minors directly.

7. Booking, scheduling, and time zones

  • Book through the site. You will receive an email confirmation with the session details and any meeting link.
  • Times are shown in your selected time zone. If a mismatch is possible (for example, you booked from a phone that auto-detected a different region), please confirm the start time in the confirmation email.
  • Sessions are delivered online via video conferencing with a shared whiteboard and screen-sharing.
  • If a calendar or booking form fails to load, email me and I will schedule manually.

8. Pricing and payments

  • Current rates per subject are published on /pricing and on each individual /tutoring subject page.
  • Rates may change with notice. Sessions already booked are honoured at the rate in effect when you paid.
  • USD is the canonical billing currency. The currency selector in the header converts displayed prices to CAD, EUR, GBP, AUD, and INR using a reference rate refreshed quarterly; the amount you are actually charged is the converted amount shown at checkout.
  • Card payments are processed by Stripe. PayPal is offered as an alternative. I never see or store your full card number.
  • Payment is required before a session is confirmed.
  • Failed or chargeback'd payments may result in cancellation of upcoming sessions.

9. Cancellations, reschedules, no-shows

Individual sessions

  • 12 or more hours' notice: reschedule or cancel a single booked session at no charge.
  • Less than 12 hours' notice: the session may be charged in full. I may waive this for genuine emergencies — please reach out.
  • No-show: the full session fee applies. I will wait 15 minutes after the scheduled start before marking the session as a no-show.

Repeated rescheduling

Frequent rescheduling makes the calendar hard to manage. Repeated reschedules of the same session may result in forfeiture of that session or of unused package credits.

10. Refunds

The published refund policy is:

  • Single sessions you have not yet taken: fully refundable.
  • Packages and monthly plans: within 30 days of purchase you may request a pro-rated refund on the unused portion. Used sessions are pro-rated at the per-pack rate.
  • First paid session not a fit: tell me within 24 hours of the session and I will either make it right or refund that session.
  • Add-ons (recording, summary, etc.): if the add-on was not actually delivered, it is refunded in full.

Refund requests are handled within 5 business days. Refunds are issued to the original payment method via Stripe or PayPal; depending on your bank, the credit can take 5–10 additional business days to appear.

11. Code of conduct

A tutoring session is a small, focused, two-way collaboration. Please:

  • Treat me, and anyone else on a session, with respect. No harassment, slurs, threats, or sexually inappropriate behaviour.
  • Do not record a session without my prior consent. I will not record without yours (see section 12).
  • Do not redistribute paid lesson materials I author for you.
  • Do not use the platform to promote competing services or to recruit my other students.
  • Do not attempt to disrupt, reverse-engineer, or probe the security of the site beyond what is needed to use it.

Violations of this section can result in cancellation of the session and of any future bookings, with refunds handled under section 10 at my reasonable discretion.

12. Recordings and session content

  • Sessions are not recorded by default. If you purchase the Recording add-on, the session is recorded with your explicit consent and the recording is stored privately in your account for you to download.
  • I may take written notes and produce a recap email after each session. Recap emails are shared only with you.
  • I may use anonymized excerpts of a session (without your name, image, voice, or any other identifying detail) as case-study material in marketing or blog posts. If you would prefer I never do this for your sessions, tell me and I will note it on your account.
  • If, in any session, anyone is recorded without consent, the recording must be deleted immediately on request.

13. Intellectual property

  • Material I author (lesson plans, slides, written summaries, code I write to teach a concept) remains mine. You receive a personal, non-exclusive licence to use it for your own learning. Please do not republish it or share it on tutoring marketplaces.
  • Work you author and submit (your code, your notebooks, your assignment drafts) stays yours. By sharing it with me you grant me a limited licence to review, mark up, and store it as part of providing the service.
  • Third-party materials (textbook excerpts, open-source code, library documentation) remain governed by their own licences.
  • If you would prefer that none of your work be used even in anonymized case studies, tell me and I will note it on your account.

14. Custom projects

Custom project work is separate from regular tutoring. Each project starts with a free scoping call, after which I send a written quote covering deliverables, timeline, revision rounds, and payment milestones.

  • The listed starting prices on /projects cover small, clearly scoped tasks. Larger projects are quoted individually after I review the requirements.
  • Each project quote includes a defined number of revision rounds. Additional work outside that scope is billed separately and agreed in writing before I do it.
  • Unless the project quote says otherwise, the code I write for you is delivered with a perpetual licence for your internal use. I retain the right to reuse generic utilities, patterns, and ideas in other projects.
  • If a project is cancelled mid-way, you pay for the work completed up to the cancellation date.

15. Privacy

Personal information you give me is handled according to the Privacy Policy, which is part of these terms by reference.

16. Disclaimer of warranties

The service is provided on an “as is” and “as available” basis. I do not warrant that the site will be uninterrupted, error-free, or free of harmful components, nor that any particular tutoring or project outcome — a grade, a job, a passing exam result — will be achieved. To the maximum extent permitted by law, all implied warranties (merchantability, fitness for a particular purpose, non-infringement) are disclaimed.

17. Limitation of liability

To the maximum extent permitted by law, my total liability to you for any claim arising out of or relating to these terms or your use of the service is limited to the amount you paid me in the 12 months preceding the claim.

I am not liable for any indirect, incidental, special, consequential, or punitive damages, including lost grades, lost income, lost data, or lost business opportunities, even if I have been advised of the possibility.

18. Termination

You can close your account at any time by emailing me. Unused single sessions and package credits are refunded under section 10.

I may suspend or close an account for material breach of these terms (including section 4 on academic integrity and section 11 on conduct), for non-payment, or in response to a credible legal request.

19. Governing law

These terms are governed by the laws of Canada. Any dispute that cannot be resolved informally will be heard by the competent courts in Canada. I encourage you to email me first — the vast majority of issues are resolved that way.

20. Changes to these terms

I may update these terms from time to time. The “Last updated” date at the top reflects the most recent revision. Material changes are announced by email to active users or by a notice on the site at least 30 days before they take effect. Continued use of the service after that period means you accept the revised terms.

21. Severability

If any provision of these terms is found unenforceable, the rest stays in effect.
